Terms of service

These Terms of Service ("Terms") form an agreement between you and the individual owner of Scrollsmith concerning Scrollsmith, usescrollsmith.com, the related browser extension, accounts, themes, and paid features (the "Service"). By using the Service, you agree to these Terms and the Privacy Policy.
The Service
Scrollsmith changes the visual appearance of native website scrollbars. Free accounts receive the disclosed Free features. An eligible paid account may receive Premium themes, advanced customization, per-site presets, and other features described at checkout. Browser, operating-system, and website restrictions may limit or simplify particular designs.
Eligibility and authority
You must be at least 13 years old to create an account or use the Service. If you are 13 through 17 years old, you may use the Service only with permission from your parent or legal guardian, and that parent or guardian must review and agree to these Terms on your behalf. A Premium purchase by a person under 18 must be authorized by the parent or legal guardian. People under 13 may not create an account, purchase Premium, or use the Service.
During account creation, you must confirm that you are at least 18 years old or that you are at least 13 years old and have permission from your parent or legal guardian. We record the confirmation and policy version without asking for your date of birth. You must also be legally able to enter into this agreement under applicable law. If you use the Service for an organization, you represent that you are authorized to accept these Terms for that organization.
Accounts
You must provide accurate account information, protect access to your email and devices, and notify us at hello@usescrollsmith.com if you suspect unauthorized access. You may not share, sell, or transfer an account in a way that circumvents plan limits. We may require email verification and may suspend sessions that appear compromised.
License and permitted use
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the Service for its intended personal or internal business purpose. This license does not transfer ownership of the Service, theme designs, branding, or code.
Free and Premium access
Free features may be changed or discontinued with reasonable notice where practicable. Premium features require an authenticated account and active server-confirmed entitlement. Reaching a success page, editing local storage, or modifying an unpacked extension does not create a valid Premium entitlement.
Payments, renewal, and cancellation
Stripe processes checkout and billing. Scrollsmith Premium costs $19.99 USD per year, plus applicable taxes, and automatically renews annually at $19.99 until canceled. Before Checkout opens, you must expressly consent to the annual charge and automatic renewal using an unchecked checkbox displayed beside these terms.
You can turn off automatic renewal immediately online from Account Billing or use the Stripe Customer Portal. Cancellation prevents the next annual charge; unless applicable law or the Refund Policy requires otherwise, already-paid Premium remains available through the displayed billing-period end and the completed period is not retroactively refunded.
You authorize Stripe and us to charge the displayed amount and applicable taxes using the payment method you provide to Stripe. If payment fails, Premium access may be restricted or revoked after any legally required notice or grace period.
Refunds and consumer rights
Refund eligibility is governed by the Refund Policy and any non-waivable rights under applicable law. Nothing in these Terms excludes rights that cannot lawfully be excluded.
Acceptable use
You must follow the Acceptable-Use Policy. Among other things, you may not attack the Service, bypass account or payment controls, misuse another person's account, distribute malware under our name, or use the Service unlawfully.
Third-party services and websites
The Service works with Chrome and may interact visually with websites you visit. We do not control those websites, browser platforms, Stripe, Supabase, Vercel, or their policies. Your use of third-party services is also governed by their terms. Scrollsmith is not endorsed by a third-party website merely because the extension can style a scrollbar shown on that site.
Intellectual property and feedback
The Service, original theme designs, names, interface, documentation, and associated intellectual property belong to the individual owner of Scrollsmith or its licensors. You retain rights in feedback you submit, but you grant us permission to use voluntary feedback to improve the Service without an obligation to compensate you. This does not grant us rights to private webpage content, which the extension is not designed to collect.
Updates and availability
We may provide updates for compatibility, security, accessibility, or product development. Features may change as browser APIs evolve. We do not promise that every theme will appear identically on every browser, operating system, website, zoom level, or accessibility mode. We may temporarily interrupt the Service for maintenance, security, or circumstances outside our control.
Suspension and termination
You may stop using the Service and request account deletion. We may suspend or terminate access if reasonably necessary to address nonpayment, security risk, unlawful activity, material breach, or harm to the Service or others. Where required, we will provide notice and an opportunity to appeal or cure.
Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties that may lawfully be disclaimed, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted availability, compatibility with every website, or that a visual theme will override all site or browser styling. Professional counsel must adapt this section to California and United States law.
Limitation of liability
To the extent permitted by law, the individual owner of Scrollsmith will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Service. Any enforceable monetary cap, exclusions, and consumer carve-outs must be selected and approved by professional counsel for California, United States before launch.
Indemnity
Where legally permitted, you agree to be responsible for third-party claims arising from your unlawful use of the Service or material violation of these Terms. Professional counsel must determine the proper scope and whether this clause is appropriate for the intended customers and jurisdiction.
Governing law and disputes
These Terms are governed by the laws of California and applicable United States federal law, without regard to conflict-of-law rules. The forum, venue, arbitration decision, class-action treatment, small-claims rights, and mandatory consumer-law exceptions require professional legal review and are intentionally not invented in this template.
Changes to these Terms
We may update these Terms for product, legal, or security reasons. We will change the effective date and provide additional notice when required. If you do not agree to revised Terms, you must stop using the Service and cancel future renewals.
